Who we are
Spark Solutions is a design and build studio trading in the United Kingdom. Our registered company name, number and address are set out in every proposal and order confirmation we send, and we will give them to you at any time on request.
You can reach us through the booking page on this site, or by replying to any email we send you. When these terms say ‘we’ or ‘us’ they mean Spark Solutions; ‘you’ means the person or business buying from us.
These terms
These terms apply to every package and project you buy from us, together with the quote or order summary you accept. If the two ever disagree, the quote or order summary wins.
We may update these terms from time to time. The version that applies to your project is the one in place on the day you place your order.
Packages and quotes
Each package describes what is included: the pages, screens, automations or brand pieces, the number of revision rounds, and the steps we will take with you. Anything not listed is not included, but we are always happy to quote for it.
A quote is valid for the period written on it. Prices are shown in the currency written on the quote or order summary, which also says whether VAT or any other tax is included.
Ordering and payment
Your order is accepted when we confirm it in writing, by email or in your dashboard. That confirmation is the start of our agreement.
Your quote or order summary sets out when each payment is due. Card payments are handled by our payment provider; we never see or store your full card details.
If a payment is late we may pause the work until it is made. We will always tell you before we do.
How the work runs
We will agree a plan with you at the start, and you can follow every step in your dashboard. We will do the work with reasonable care and skill, and keep you up to date.
To keep to the plan we need your content, feedback and approvals when we ask for them. If they arrive late, the plan may move, and we will agree new dates with you.
Revision rounds are set out in your package. Changes beyond them, or a change in what you want built, may be quoted as extra work, and we will always ask before charging for it.
Cancelling and refunds
If you are buying as a consumer, you have the right to cancel within 14 days of your order being accepted, under the Consumer Contracts Regulations. If you ask us to start work within those 14 days and then cancel, we may keep a fair amount for the work already done.
If you are buying as a business, you can cancel at any time by telling us in writing. You pay for the work done up to that point, and your quote sets out how any deposit is treated.
If something we deliver is not as described, tell us and we will put it right. If we cannot, you may be entitled to a refund for that part of the work.
What you give us
You are responsible for the content you give us (words, photographs, logos, data) and for having the right to use it. Please do not send us anything you do not have permission to share.
Who owns the work
Once you have paid in full, the finished designs, code and brand pieces we make for you are yours, except for the parts listed below.
We keep the tools, methods, templates and general know how we bring to every project, and we give you a licence to use any of them that end up in your work. Third party items, such as fonts, stock images or software libraries, stay under their own licences, and we will tell you about any that need a paid licence.
We may show the work in our portfolio once it is public, unless you ask us not to.
Other services
Your project may rely on services run by other companies, such as hosting, domains, email, payments or scheduling. Those services have their own terms, and we are not responsible for how they run.
Our responsibility to you
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
If you are a business, we are not responsible for indirect losses such as lost profits, lost data or lost opportunities, and our total responsibility to you is limited to the amount you paid for the package or project concerned.
If you are a consumer, we are only responsible for losses that were foreseeable when the agreement was made.
Ending the agreement
Either of us can end the agreement in writing if the other seriously breaks these terms and does not put it right within a reasonable time of being asked. If it ends, you pay for the work done up to that point and we hand over what you have paid for.
Complaints
If something is not right, tell us by replying to any email from us or through your dashboard, and we will reply as soon as we can. We would always rather fix it with you directly.
The law that applies
These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
